Welcome to ProFRSH. These Terms of Service ("Terms") govern your access to and use of our website at profrsh.in, as well as the purchase and consumption of our products. ProFRSH is a registered food business operating under FSSAI License No. 11526997000346. By accessing our website, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must discontinue use of our website and services immediately.

Eligibility

Our website and products are intended for individuals who are eighteen (18) years of age or older. By using our website or placing an order, you represent and warrant that you are at least eighteen years of age and have the legal capacity to enter into a binding agreement. If you are under eighteen, you may only use our website under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

Products

ProFRSH offers ready-to-drink protein milkshakes in 240ml bottles, each containing 22 grams of high-quality protein. Our products are available in four flavours: Chocolate, Coffee, Strawberry, and Vanilla. All products are manufactured in compliance with FSSAI regulations and bear our FSSAI License No. 11526997000346 on every bottle. Product descriptions, images, and nutritional information provided on our website are presented as accurately as possible. However, slight variations in colour, packaging, or presentation may occur between what is displayed on screen and the actual product received, owing to differences in screen display settings and periodic packaging updates.

Pricing and Payment

Each bottle of ProFRSH protein milkshake is priced at ₹170. All prices displayed on our website are in Indian Rupees and are inclusive of applicable taxes unless otherwise stated. We reserve the right to modify product pricing at any time without prior notice; however, any price change will not affect orders that have already been confirmed and paid for. All orders are processed through our Shopify-powered secure checkout. We accept UPI, credit cards, debit cards, net banking, wallets, and other payment methods available through Shopify Payments. An order is deemed confirmed only upon successful payment and receipt of an order confirmation email from us. We reserve the right to cancel or refuse any order due to product unavailability, pricing errors, suspected fraudulent activity, or any other reason at our sole discretion. In such cases, a full refund will be processed to the original payment method.

Order Fulfilment

Once an order is confirmed, we endeavour to process and dispatch it within one to two (1–2) business days. Orders placed on weekends or public holidays will be processed on the next business day. You will receive a shipping confirmation email containing your tracking details once your order has been dispatched. Estimated delivery timelines vary based on your location: three to five (3–5) business days for metro cities, five to seven (5–7) business days for tier-2 and tier-3 cities, and seven to ten (7–10) business days for remote areas. These timelines are estimates and may be affected by factors beyond our control, including courier delays, adverse weather, or local restrictions. Orders above ₹999 qualify for free shipping; for orders below this threshold, standard shipping charges apply as calculated at checkout.

Cancellations

You may cancel your order at any time before it has been dispatched by contacting us at hello@profrsh.in with your order number. Once an order has been dispatched, it cannot be cancelled. Refunds for successfully cancelled orders will be processed within five to seven (5–7) business days to the original payment method.

Returns and Replacements

As ProFRSH is a consumable food product, we do not accept returns on products that have been opened, partially consumed, or fully consumed. We do not offer refunds or replacements based on taste preference, flavour dissatisfaction, or change of mind. This policy is in line with food safety and hygiene standards mandated by the FSSAI.

Replacements are offered exclusively in the following circumstances: the product was damaged during transit (bottle cracked, leaking, or visibly crushed), the product has a manufacturing defect (bloated packaging, off-odour, or quality issue within the stated shelf life), or you received an incorrect product or flavour. To be eligible for a replacement, you must report the issue within forty-eight (48) hours of delivery by emailing hello@profrsh.in with your order number, a clear description of the issue, and photographs of the affected product and packaging. Our team will review your claim and, upon verification, dispatch a replacement at no additional cost. In the event that a replacement is not possible due to stock unavailability, we will process a refund to your original payment method. We do not offer cash refunds, cheque payments, or store credits as alternatives.

Intellectual Property

All content on this website, including but not limited to the ProFRSH brand name, logos, trademarks, product images, graphics, text, page layouts, and design elements, is the exclusive intellectual property of ProFRSH and is protected under applicable Indian intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from our website without our prior written consent. Unauthorised use of our intellectual property may result in legal action under the Trade Marks Act, 1999, the Copyright Act, 1957, and other applicable statutes.

Disclaimer

ProFRSH protein milkshakes are food products intended to supplement your dietary protein intake. Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. They are not a substitute for a balanced and varied diet or for professional medical advice. If you have any specific health conditions, dietary restrictions, allergies, or are pregnant or nursing, we strongly recommend consulting a qualified healthcare professional before consuming our products. Nutritional information provided on our website and product labels is based on standard laboratory analysis and may vary slightly from batch to batch.

Limitation of Liability

ProFRSH provides its products and website on an "as is" and "as available" basis. While we strive to maintain the highest standards of product quality and website functionality, we make no warranties or representations, express or implied, beyond those required by applicable Indian consumer protection laws. To the maximum extent permitted by law, ProFRSH, its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our website, purchase of our products, or reliance on any information provided herein. Our total aggregate liability in connection with any order shall not exceed the amount actually paid by you for that specific order. Nothing in these Terms excludes or limits your statutory rights as a consumer under the Consumer Protection Act, 2019, or any other applicable Indian legislation.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes, claims, or controversies arising out of or relating to these Terms, your use of our website, or the purchase of our products shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.

Amendments

We reserve the right to update, modify, or replace any part of these Terms at any time. Any changes will be posted on this page with a revised "Last Updated" date. It is your responsibility to review these Terms periodically. Your continued use of our website or purchase of our products after any changes are posted constitutes your acceptance of the revised Terms.
